Welcome to Leaf Palms. These Terms and Conditions ("Terms") govern your access to and use of leafpalms.com and every related page, service, and purchase (together, the "Site"). By browsing the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the Site.

1. About Leaf Palms

Leaf Palms ("Leaf Palms", "we", "us", "our") is a Houston, Texas company that sells tobacco-free, hand-rolled palm and rose wraps, pre-rolled cones, and related accessories and merchandise to adults. You can reach us at [email protected].

2. Eligibility and Age Requirement

• You must be at least 21 years old to enter the Site, create an account, or buy from us. We may ask you to confirm your age on entry, at checkout, or on delivery.
• By placing an order you confirm that you are 21 or older, that you are legally allowed to buy and possess our products where you live, and that you are buying for yourself or for another adult.
• We may cancel any order, refuse service, or close any account where we believe the buyer is under 21 or that an order breaks local law. Orders placed by minors are void and will be refunded.
• Some carriers require an adult signature on delivery. If delivery is refused or cannot be completed for that reason, the shipping cost and any return costs are not refundable.

3. Our Products

• Our wraps and cones are sold as tobacco-free, nicotine-free rolling papers and related smoking accessories. They are not intended for use by anyone under 21.
• We do not make medical or health claims. Nothing on the Site is medical advice, and no product is intended to diagnose, treat, cure, or prevent any disease.
• Flavors, colors, sizes, and packaging may vary slightly between batches. Photos and descriptions are as accurate as we can make them, but your screen may not show true colors, and natural plant materials can differ from piece to piece.
• You are responsible for knowing and following the laws that apply to the products you buy and where you use them. We do not ship where our products are restricted.

4. Your Account

• You may browse the Site without an account, but you may need one to check out faster, view orders, and manage your details.
• Keep your sign-in details secret. You are responsible for everything done through your account. Tell us at once if you think someone else is using it.
• Give us true, current, and complete information. We may suspend or close an account, or block a customer from the Site, if we find false details, abuse, fraud, chargeback abuse, or a breach of these Terms.

5. Orders, Prices, and Payment

• All prices are in US dollars and do not include shipping or taxes unless stated. Prices, offers, and availability can change at any time without notice.
• An order is an offer to buy. We accept it when we send the shipping confirmation. We may decline or cancel any order, in whole or in part, for reasons such as stock errors, pricing errors, suspected fraud, or failed age or address checks. If we cancel a paid order, you will be refunded in full.
• We accept the payment methods shown at checkout, including PayPal and major cards. Payments are handled by our payment providers. We do not store full card numbers on our servers.
• By paying you confirm that you are allowed to use the payment method. If a payment is declined, reversed, or disputed, we may cancel the order and hold further orders until it is settled.
• Sales tax is added where required by law.

6. Discounts, Promotions, and Pop-up Offers

• Discount codes, sale events, free-shipping thresholds, and pop-up offers are available while they last and may have a minimum spend, an end date, or a use limit.
• Unless an offer says otherwise, a code can be used once per customer, cannot be combined with other codes, has no cash value, and cannot be applied to an order after it is placed.
• Codes created for one person (for example, a code sent after you join our email list) are personal and may not be shared or sold.
• We may withdraw an offer or cancel orders that misuse one, including through multiple accounts or automated tools.

7. Shipping and Delivery

• We ship within the United States, mainly with USPS. Delivery times shown at checkout are estimates, not promises, and can be affected by carriers, weather, holidays, and customs.
• Orders over the free-shipping amount shown on the Site ship free; otherwise the shipping cost is calculated at checkout.
• Risk of loss passes to you when the carrier delivers the package to the address you gave us. Please check your shipping address carefully; we are not responsible for orders sent to an address entered incorrectly.
• If a package is lost or arrives damaged, contact us within 7 days of the delivery date (or the expected date for lost parcels) so we can help.

8. Returns, Refunds, and Cancellations

Our Refund Policy is part of these Terms. In short: because our consumable products cannot be resold once shipped, all sales of wraps, cones, and similar items are final, except that we will replace or issue store credit for items that arrive damaged or incorrect when you contact us within 7 days of delivery. Apparel and merchandise may be returned within 14 days in unused condition. To request a return, email [email protected] with the subject "Return Request – Order #" and your order number.

9. Wholesale

Wholesale and bulk pricing is offered to approved businesses only. A wholesale application, or an order at wholesale prices, is subject to our review, to proof that you are a lawful reseller, and to any additional written terms we give you. Wholesale customers are responsible for following all licensing, tax, and age-restriction laws that apply to their sales.

10. Acceptable Use

When using the Site you agree not to:

• break any law or help anyone else to do so;
• buy for resale (except through an approved wholesale account) or sell to anyone under 21;
• use bots, scrapers, or other automated tools, or try to overload, probe, or bypass the security or the password, age, or blocking features of the Site;
• submit false orders, abuse discount codes, or file false claims or chargebacks;
• upload malicious code or post content that is unlawful, hateful, harassing, or infringing;
• pretend to be another person or company.

11. Reviews and User Content

If you post a review, comment, photo, or message on the Site, you keep ownership of it but give Leaf Palms a free, worldwide, non-exclusive right to use, show, and adapt it for running and promoting the store. You promise that you have the right to post it and that it is truthful and does not break any law or anyone's rights. We may remove any content at our discretion.

12. Intellectual Property

The Leaf Palms name, logos, product names, photographs, text, graphics, designs, and the Site itself belong to Leaf Palms or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, sell, or create works from our content without written permission.

13. Email and Text Messages

If you join our email list or accept marketing messages, you agree to receive offers and news from us. You can unsubscribe at any time using the link in any email or by contacting us. 14. Third-Party Services and Links

The Site may link to or use services run by others (for example payment, shipping, and email providers). We do not control them and are not responsible for their content, practices, or availability. Your use of them is subject to their own terms.

15. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available". To the fullest extent the law allows, Leaf Palms disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will always be available, secure, or free of errors. Some states do not allow certain exclusions, so part of this section may not apply to you.

16. Limitation of Liability

To the fullest extent the law allows, Leaf Palms and its owners, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.

17. Indemnity

You agree to defend and hold harmless Leaf Palms and its owners, employees, and partners from any claim, loss, or expense (including reasonable legal fees) that comes from your breach of these Terms, your misuse of the products, or your violation of any law or third-party right.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules. Please contact us first so we can try to resolve any dispute informally. If we cannot, you and Leaf Palms agree that the state and federal courts located in Harris County, Texas have exclusive jurisdiction, and you consent to their authority. Where the law gives you the right to bring a claim in another place, that right is not affected.

20. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Changes apply from the day they are posted, and your continued use of the Site or a new order means you accept them. Orders already placed are covered by the Terms that applied when you placed them.

21. General

If any part of these Terms is found unenforceable, the rest stays in force. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours. These Terms, with the Privacy Policy and Refund Policy, are the entire agreement between you and Leaf Palms about the Site.
